Terms of Service

These Terms of Service ("Terms") are an agreement between you (or the organisation you represent) and Pingtail Partners ("we", "us") for the use of the Pingtail website, dashboard, data files and API (the "Service").

1. Accounts

You must give accurate account information, keep your password and API keys confidential, and tell us promptly about any unauthorised use. You are responsible for activity under your account. You must be at least 18 and able to enter into a contract.

2. The data and your licence

2.1 The Service provides business records compiled by our team from official registries and business sources, described on the data sources page.

2.2 While your plan is active, we grant you a non-exclusive, non-transferable licence to use the data you are entitled to for your own internal business purposes.

2.3 You may not: resell, sublicense, publish or share the data or files with third parties; use the data to build or improve a competing data product; remove or alter the licence reference in files; or access the Service by scraping or by any means other than the dashboard and the API.

2.4 Files contain a licence reference that identifies the download. We may include a small number of control records to detect unauthorised redistribution. [OWNER DECISION: confirm or delete this sentence.]

3. Your compliance obligations

You are solely responsible for how you use the data, including compliance with the CAN-SPAM Act, the Telephone Consumer Protection Act, the Telemarketing Sales Rule, Do Not Call rules, state laws and any other law that applies to your outreach. See CAN-SPAM and TCPA responsibilities and the Acceptable Use Policy. The data must not be used as a consumer report or for any purpose covered by the Fair Credit Reporting Act.

4. Plans, payment and cancellation

4.1 Prices are shown on the pricing page in the currency you choose. PayPal processes payments; Pingtail Partners is the seller.

4.2 Subscriptions renew automatically at the end of each billing period until cancelled. When you cancel, access continues until the end of the paid period.

5. Availability and changes

We aim to keep the Service available and the data fresh, but we do not guarantee uninterrupted availability. A feed is not delivered when its status checks are older than the feed allows. Sources can change or become unavailable; we may change feeds, fields and schedules when that happens.

6. Disclaimers

The data reflects information filed by third parties with government agencies and is checked as described on our site on the dates shown. THE SERVICE AND THE DATA ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, INCLUDING ACCURACY, COMPLETENESS OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY LAW.

7. Limitation of liability

8. Suspension and termination
