CAN-SPAM and TCPA responsibilities

Email: the CAN-SPAM Act

• Do not use false or misleading header information or deceptive subject lines.
• Identify the message as an advertisement where required.
• Include a valid physical postal address.
• Give a clear way to opt out, and honor opt-out requests within 10 business days.
• You remain responsible even when someone else sends email on your behalf.

Calls and texts: the TCPA and the Telemarketing Sales Rule

• Calls or texts to mobile numbers using an autodialer, and calls using an artificial or prerecorded voice, generally require prior express consent, and prior express written consent for telemarketing.
• Most US numbers cannot be classified as mobile or landline from the number alone. In our files phone_type is usually either (unknown); mobile or landline appear only when the number is positively typed. Where a carrier registered a cell phone number we show it separately (cell_phone, filter has_cell). Treat every number as possibly mobile when you decide whether consent rules apply; number types also change when numbers are ported.
• We do not scrub numbers against the National Do Not Call Registry or state lists. Check the rules that apply to your calls, including whether business-to-business exemptions apply in the states you call.
• Respect calling-hour limits in the recipient's time zone; our time_zone column helps.
• Keep an internal do-not-contact list and honor it.

State laws

Several states have their own telemarketing, texting and privacy laws that can be stricter than federal law. Check the states you target.

Removals

If someone asks to be removed from our data, direct them to our removal page. Removed records are excluded from future files and API responses for all customers, and you must not re-add them from earlier downloads.
